CFPB ISSUES CREDIT REPORTING GUIDANCE DURING COVID-19 PANDEMIC

WASHINGTON, D.C. — The Consumer Financial Protection Bureau (Bureau) today released a policy statement outlining the responsibility of credit reporting companies and furnishers during the COVID-19 pandemic.  In response to the pandemic, many lenders are being flexible when it comes to consumers’ making payments.  The Bureau’s statement underscores that consumers benefit if lenders report accurate information about these arrangements to credit bureaus so that the credit reports of consumers are accurate.

“During this time of uncertainty, we are providing clarity to ensure the consumer reporting industry can continue to function,” said Director Kraninger.  “Consumers rely on their credit report to purchase a new car, their new home, or to finance their college education.  An effective consumer reporting system is critical in promoting fair and efficient access to credit in the consumer financial services market.”

As lenders continue to offer struggling borrowers payment accommodations, Congress last week passed the CARES Act.  The Act requires lenders to report to credit bureaus that consumers are current on their loans if consumers have sought relief from their lenders due to the pandemic.  The Bureau’s statement informs lenders they must comply with the CARES Act.  The Bureau’s statement also encourages lenders to continue to voluntarily provide payment relief to consumers and to report accurate information to credit bureaus relating to this relief.  The continuation of reporting such accurate payment information produces substantial benefits for consumers, users of consumer reports, and the economy as a whole.

In addition, in response to staffing and resources constraints on lenders and credit bureaus due to the pandemic, the Bureau’s statement also provides flexibility for lenders and credit bureaus in the time they take to investigate disputes.   The Bureau specifically states that it does not intend to cite in an examination or bring an enforcement action against firms who exceed the deadlines to investigate such disputes as long as they make good faith efforts during the pandemic to do so as quickly as possible.

Earlier this month, the Bureau provided consumers with resources to protect their credit.  The Bureau’s blog outlines the steps consumers should take if they cannot make a payment, how to dispute inaccurate information on their credit report, and how to obtain a free copy of their credit report.  The blog can be found here.

FORT WORTH, Texas – The legendary Billy Bob’s Texas, located in the heart of the Fort Worth Stockyards National Historic District, first opened in 1981. While concerts for April have been postponed due to social distancing as a result of the COVID-19 virus, the colossal Billy Bob’s Texas will continue their concerts as soon as possible.

While events may have been halted temporarily, Billy Bob’s Texas is doing their part to help the community and give back wherever possible. As part of a local effort, Billy Bob’s Texas recently partnered with Carter Bloodcare for a special community blood drive. A total of 339 units of blood were collected as a result and will be used to aid those in need.

As a way to celebrate the 39th anniversary of Billy Bob’s Texas on April 1, there will be a special watch party featuring some of the area’s most well known local talent. Artists performances will include Abraham Alexander, Austin Allsup, Bonnie Bishop, Chad Prather, Brad Thompson, Grady Spencer, Jack Barksdale, Jerrod Flusche, Johnny Cooper, Josh Weathers, Kris Luv, Matthew McNeal, Michael Lee, Rob Redwine, Smooth Vega, Summer Dean and more!

The initiative spearheaded by Hear Fort Worth is an extension of Fort Worth musician Rachel Gollay’s Artist & Service Worker Relief Fund.

CFPB PROVIDES FLEXIBILITY DURING COVID-19 PANDEMIC

WASHINGTON, D.C. – The Consumer Financial Protection Bureau (Bureau) today announced that it is providing needed flexibility to enable financial companies to work with customers in need as they respond to the COVID-19 pandemic. The Bureau is postponing some data collections from industry on Bureau-related rules to allow companies to focus on responding to consumers in need and making changes to its supervisory activities to account for operational challenges at regulated entities.

“As consumers seek temporary relief from lenders, the pandemic is impacting the operations of financial companies that are eager to help their customers during this unprecedented time,” said Director Kathleen L. Kraninger. “Our actions today are temporary and targeted to support consumers by allowing financial companies to focus their resources on assisting consumers.

“The Bureau, along with our state and federal partners, have released prior guidance encouraging financial institutions to work constructively with borrowers and other customers affected by COVID-19 to meet their financial needs. We will continue to issue additional guidance and policies to facilitate the ongoing collaborative relationship between companies and their customers during this time,” concluded Director Kraninger.

The Bureau will not expect quarterly information reporting by certain mortgage lenders as required under the Home Mortgage Disclosure Act (HMDA) and Regulation C. During this time, entities should continue collecting and recording HMDA data in anticipation of making annual submissions. The Bureau will provide information on when and how institutions will be expected to commence what would have been new quarterly HMDA data submissions.

The Bureau also will not expect the reporting of certain information related to credit card and prepaid accounts under the Truth in Lending Act, Regulation Z, and Regulation E. This includes the annual submissions concerning agreements between credit card issuers and institutions of higher education; quarterly submission of consumer credit card agreements; collection of certain credit card price and availability information; and submission of prepaid account agreements and related information.

Additionally, the following data collections are being postponed:

a survey of financial institutions that seeks information on the cost of compliance in connection with pending rulemaking on Section 1071 of the Dodd-Frank Act; and
a survey of firms providing Property Assessed Clean Energy financing to consumers for the purposes of implementing Section 307 of the Economic Growth, Regulatory Relief, and Consumer Protection Act.

To the extent the submission of this information is required by law, the Bureau is issuing policy statements indicating that it does not intend to cite in an examination or initiate an enforcement action against any entity for failure to submit such information when required. The Bureau will notify entities at a later date of when and how to submit information under these requirements. Entities should maintain records sufficient to allow them to make delayed submissions pursuant to Bureau guidance.

The Bureau also announced that as a result of operational challenges confronted by institutions due to the pandemic, the Bureau will work with affected financial institutions in scheduling examinations and other supervisory activities to minimize disruption and burden. When conducting examinations and other supervisory activities and in determining whether to take enforcement action, the Bureau will consider the circumstances that entities may face as a result of the COVID-19 pandemic and will be sensitive to good-faith efforts demonstrably designed to assist consumers.

CONSUMER FINANCIAL PROTECTION BUREAU ISSUES REQUEST FOR INFORMATION TO ASSIST TASKFORCE ON FEDERAL CONSUMER FINANCIAL LAW

WASHINGTON, D.C. – The Consumer Financial Protection Bureau (Bureau) issued today a request for information (RFI) to assist the Taskforce on Federal Consumer Financial Law (Taskforce) with recommendations on harmonizing, modernizing, and updating the federal consumer financial laws.

The Taskforce seeks input from the public at this time to help identify areas of consumer protection on which it should focus its research and analysis during the balance of its one-year appointment.  The RFI will be one of multiple opportunities for the public to provide feedback directly to the Taskforce and thus to help inform its recommendations.  More specifically, the RFI seeks comments and other information on the following topics: expanding access to consumer financial products and services; protection and use of consumer data; regulations the Bureau writes and enforces; federal and state coordination; and improving the market for consumer financial products and services.  The comment period for the RFI will close 60 days after the date of its publication in the Federal Register.  The comment deadline will be provided on the Bureau’s website.

The Taskforce is an independent body within the Bureau and reports to Director Kathleen L. Kraninger.  It is charged with examining the existing legal and regulatory environment facing consumers and financial services providers and reporting its recommendations for ways to improve and strengthen federal consumer financial laws to the Bureau’s Director.  The Taskforce’s recommendations may include actions that the Bureau could carry out using its current authorities and actions that would require legislation to implement.  The Taskforce will produce new research and legal analysis of consumer financial laws in the United States, focusing specifically on harmonizing, modernizing, and updating the federal consumer financial laws—including their implementing regulations—and identifying gaps in knowledge that should be addressed through research, ways to improve consumer access to and understanding of markets and products, and potential conflicts or inconsistencies in existing regulations and guidance.

The Taskforce members were announced in January 2020 and they are expected to deliver their findings to Director Kraninger within the span of one year.

The public is invited to submit written comments on the RFI.  The Taskforce will carefully consider the comments before delivering its findings to the Director.

A SPECIAL NOTE ON JAN HOWARD

In addition to Joe Diffie, the country music community lost my dear friend, Jan Howard, this weekend. Jan was the oldest living member of the Grand Ole Opry, having just celebrated her 91st birthday. My full thoughts and remembrance of her can be read on my Facebook page. Her ties to our 117 family run deep, especially with one of her closest friends, Bobby Bare. Both Bare and Jan have told me stories of when he would visit Nashville, prior to moving here in the early ’60s. He would sleep in Jan’s bathtub if there wasn’t an open couch or bed in the house! In college, I interviewed Jan and we went deep into her story and the loss of her sons, it was an intense and emotional interview, I will forever cherish this memory along with all the others I have with Jan, including square dancing at the Longhollow Jamboree and brunching at the Loveless Cafe. – Zach Farnum

Included in the CARES act are critical provisions from Senator Marco Rubio’s bipartisan Keeping American Workers Paid and Employed Act, a small business emergency economic relief plan that provides more than $377 billion for small businesses to meet their payroll and expenses, and receive education and assistance throughout the coronavirus pandemic. Provisions like the Paycheck Protection Program in this act will assist small businesses in retaining employees through these difficult times. The program has $350 billion dollars to support employers with 500 employees or less to maintain their payroll. This program is retroactive to February 15, 2020 to help bring workers who may have already been laid off back onto payrolls as well. Many PCA members will be eligible for provisions of the CARES act when it is signed into law.

USA Boxing National Office Staff Working Remotely and Recommends Gyms Close Until March 31

USA Boxing national office staff has been monitoring and receiving updates from the United States Olympic and Paralympic Committee (USOPC), who is working the World Health Organization (WHO) and the United States Center for Disease Control (CDC) regarding Coronavirus (COVID-19).

Based on the recommendation of the USOPC and the El Paso County Colorado Health Department and to minimize potential exposure to boxers, staff, their families and the public, USA Boxing is encouraging office staff to work remotely through March 31, 2020.

Also, based on the recent U.S. Government guidelines released, USA Boxing strongly recommends all boxing clubs and gyms close through March 31, 2020. We will continue to monitor and evaluate this need based on information received from government agencies and medical authorities.

For those registered clubs in cities or towns that have their local governments requiring the closing of health clubs and gyms, please follow those guidelines and requirements until those are lifted.

Staff members have the ability and are expected to perform the same duties that they normally would as if in the office. Members needing to speak with USA Boxing staff, please email or call the USA Boxing Membership Services line, membership@usaboxing.org or 719-866-2323. If calling, please leave a voicemail, and a staff member will return your call and try to assist you to the best of our abilities from home.

As a reminder, all USA Boxing sanctioned events are suspended until March 31 at this time.

Judicial Watch Victory: Federal Court Orders Deposition of Hillary Clinton on Emails and Benghazi Attack Records

Court: ‘It is Time to Hear Directly from Secretary Clinton’

(Washington, DC) Judicial Watch today announced that U.S. District Court Judge Royce C. Lamberth granted Judicial Watch’s request to depose former Secretary of State Hillary Clinton about her emails and Benghazi attack documents. The court also ordered the deposition of Clinton’s former Chief of Staff, Cheryl Mills and two other State Department officials.

Additionally, the court granted Judicial Watch’s request to subpoena Google for relevant documents and records associated with Clinton’s emails during her tenure at the State Department.

The ruling comes in Judicial Watch’s lawsuit that seeks records concerning “talking points or updates on the Benghazi attack” (Judicial Watch v. U.S. Department of State (No. 1:14-cv-01242)). Judicial Watch famously uncovered in 2014 that the “talking points” that provided the basis for Susan Rice’s false statements were created by the Obama White House. This Freedom of Information Act (FOIA) lawsuit led directly to the disclosure of the Clinton email system in 2015.

In December 2018, Judge Lamberth first ordered discovery into whether Secretary Clinton’s use of a private email server was intended to stymie FOIA; whether the State Department’s intent to settle this case in late 2014 and early 2015 amounted to bad faith; and whether the State Department has adequately searched for records responsive to Judicial Watch’s request. The court also authorized discovery into whether the Benghazi controversy motivated the cover-up of Clinton’s email. The court ruled that the Clinton email system was “one of the gravest modern offenses to government transparency.” The State and Justice Departments continued to defend Clinton’s and the agency’s email conduct.

Judge Lamberth today overruled Clinton’s and the State and Justice Department’s objections to limited additional discovery by first noting:

Discovery up until this point has brought to light a noteworthy amount of relevant information, but Judicial Watch requests an additional round of discovery, and understandably so. With each passing round of discovery, the Court is left with more questions than answers.

Additionally, Judge Lamberth said that he is troubled by the fact that both the State Department and Department of Justice want to close discovery in this case:

[T]here is still more to learn. Even though many important questions remain unanswered, the Justice Department inexplicably still takes the position that the Court should close discovery and rule on dispositive motions. The Court is especially troubled by this. To argue that the Court now has enough information to determine whether State conducted an adequate search is preposterous, especially when considering State’s deficient representations regarding the existence of additional Clinton emails. Instead, the Court will authorize a new round of discovery

With respect to Clinton, the court found that her prior testimony, mostly through written sworn answers, was not sufficient:

The Court has considered the numerous times in which Secretary Clinton said she could not recall or remember certain details in her prior interrogatory answers. In a deposition, it is more likely that plaintiff’s counsel could use documents and other testimony to attempt to refresh her recollection. And so, to avoid the unsatisfying and inefficient outcome of multiple rounds of fruitless interrogatories and move this almost six-year-old case closer to its conclusion, Judicial Watch will be permitted to clarify and further explore Secretary Clinton’s answers in person and immediately after she gives them. The Court agrees with Judicial Watch – it is time to hear directly from Secretary Clinton.

“Judicial Watch uncovered the Clinton email scandal and we’re pleased that the court authorized us to depose Mrs. Clinton directly on her email conduct and how it impacted the people’s ‘right to know’ under FOIA,” stated Judicial Watch President Tom Fitton.
