These Sevilla Rank Tracker™ Terms of Use (“Rank Tracker Terms”) govern access to and use of Sevilla Rank Tracker™ provided by Sevilla Local Media (“SLM,” “we,” “us,” or “our”). They supplement the general SLM Terms & Conditions. By creating a Rank Tracker account, accepting these terms, or using the service, you agree to these Rank Tracker Terms.
1. Service
Sevilla Rank Tracker™ is proprietary hosted software for manually requested organic search-rank monitoring, historical comparison, competitor observation and reporting. Supported features, search engines, project limits, stored-keyword limits, refresh credits, report options and pricing vary by plan and may change prospectively.
2. Account eligibility and responsibility
You must be at least 18 years old and legally able to enter into these terms. If you use the service for a business, agency or client, you represent that you are authorized to do so. You are responsible for maintaining accurate account information, safeguarding credentials and promptly reporting suspected unauthorized access.
3. Limited license and proprietary rights
Subject to these terms and applicable plan limits, SLM grants you a limited, nonexclusive, nontransferable and revocable right to use the hosted service for lawful internal business purposes and authorized client reporting. SLM retains all rights in the software, source code, user interface, database structures, workflows, templates, documentation, trademarks, service marks and other proprietary technology. No source code or intellectual-property ownership is transferred.
4. Manual-only ranking refreshes
Retail Rank Tracker plans are manual-only. The service does not initiate scheduled daily, weekly or unattended ranking scans. A ranking refresh begins only after an authenticated user affirmatively starts a run. Browser polling may continue collecting results for a run the user already initiated, but it does not create a new ranking run.
5. Stored keywords, SERP credits and usage
Stored-keyword limits and monthly SERP-refresh credits are separate. One SERP credit represents one requested block of up to 10 organic search results for one keyword on one search engine. A deeper check therefore consumes more credits. A run using multiple search engines consumes credits for each keyword/search-engine task. Competitor positions derived from the same purchased search-result data do not consume additional credits.
Before a run, the dashboard displays the planned number of keyword/search-engine tasks and the estimated SERP-credit debit. Provider-incurred work may remain billable even if a result is unavailable, delayed or ultimately returned as an error. Credits have no cash value and do not roll over unless a specific written offer states otherwise.
6. Search data and methodology
Rankings are observational snapshots and can vary by search engine, geography, language, device, requested depth, time, indexing state and search-engine conditions. Search providers may suppress, reorder or personalize results. Historical movement is based only on prior completed manual runs stored by the service. SLM does not guarantee a particular ranking, indexing result, search-engine feature, traffic level, lead volume, conversion rate or revenue outcome.
7. Third-party infrastructure
The service may rely on third-party hosting, payment, email, security and search-data providers. Search queries and related settings necessary to complete a requested rank check may be transmitted to a search-data provider. SLM may change providers, temporarily lock paid requests, impose safety limits or suspend a provider integration when reasonably necessary to control costs, protect security or maintain service integrity.
8. Plans and paid access
Free and paid plan limits are shown on the Rank Tracker product page or in a written order. Paid access may be provisioned through a supported checkout, invoice or written service arrangement. Recurring billing occurs only when you expressly authorize a recurring payment arrangement through a supported payment provider. The Rank Tracker service does not intentionally store full payment-card numbers.
Cancellation stops future renewal according to the applicable checkout, invoice or written order. Fees already earned for a current service period are not automatically refundable except as required by law or an applicable written refund policy.
9. Reports and branding
Free and Starter reports carry Sevilla Rank Tracker™ / Sevilla Local Media branding. Plans that expressly include custom branding may permit an authorized company or agency name, logo and report footer. Custom branding does not transfer ownership of the Rank Tracker software and may not be used to falsify results, obscure required methodology or no-guarantee disclosures, impersonate another party, or infringe third-party rights.
10. Acceptable use
You may not circumvent quotas, technical restrictions or security controls; probe or attack the service; share credentials in a manner that defeats plan restrictions; use automated means to create unauthorized runs; scrape or reproduce the software or private service data; reverse engineer or decompile the service except to the limited extent a nonwaivable law expressly permits; resell access without written authorization; use the service to violate law or third-party rights; or interfere with other users or SLM infrastructure.
11. Customer data and privacy
You retain your rights in domains, keywords, competitor domains, labels, project names and report-branding materials you lawfully submit. You authorize SLM to process that information as necessary to provide, secure, support and improve the service. Rank Tracker data practices are described in the SLM Privacy Policy. You are responsible for ensuring that client or third-party information you submit may lawfully be processed for the requested service.
12. Suspension and termination
SLM may restrict or suspend access for nonpayment, fraud, abuse, security threats, unlawful conduct, material breach, provider emergencies or attempts to circumvent service safeguards. Where practical, SLM may provide notice and an opportunity to cure. Ending access does not erase records SLM must reasonably retain for security, transaction, tax, consent, dispute-resolution or legal purposes.
13. Disclaimers and limitation of liability
To the maximum extent permitted by applicable law, the service is provided on an “as available” basis without a promise of uninterrupted operation or a particular search, marketing or business outcome. To the maximum extent permitted by law, SLM is not liable for indirect, incidental, special, exemplary, punitive or consequential damages, lost profits, lost business opportunities, or losses caused by search-engine changes, third-party provider failures or customer misuse.
To the maximum extent permitted by law, SLM’s aggregate liability arising from Rank Tracker will not exceed the amount you paid specifically for Rank Tracker during the three months immediately preceding the event giving rise to the claim. This limitation does not apply where applicable law prohibits the limitation.
14. Indemnification
To the extent permitted by law, you agree to defend, indemnify and hold SLM harmless from third-party claims arising from content or data you submit, your unlawful use of the service, your violation of these terms, or your infringement of another person’s rights. This provision does not require indemnification for liability that applicable law does not permit to be shifted.
15. Changes, severability and entire agreement
SLM may update these Rank Tracker Terms prospectively. Material changes may require renewed affirmative acceptance before further use. If a provision is found unenforceable, the remaining provisions remain in effect to the extent permitted by law. These Rank Tracker Terms, the general SLM Terms & Conditions, applicable privacy disclosures and any written order accepted by SLM constitute the agreement governing Rank Tracker use.
